- You are responsible for ensuring your device supports eSIM functionality before purchasing any plan.
- You agree to comply with all applicable Australian laws and regulations, including those set by the Australian Communications and Media Authority (ACMA) and other relevant authorities.
2. Service Description
- eSimDeck enables users to purchase, activate, and manage eSIM data plans on compatible devices.
- All telecommunications services are provided via third-party network operators and are subject to their respective terms and conditions.
- eSimDeck does not guarantee uninterrupted connectivity, as service quality depends on third-party telecom providers and network availability.
3. User Responsibilities
- You must provide accurate and complete information (including identity verification where required) in accordance with applicable laws.
- You agree not to use eSimDeck services for unlawful, fraudulent, or harmful activities.
- You are responsible for maintaining the confidentiality of your account and securing your device.
4. Payments & Refunds
- All payments are processed securely via approved payment gateways.
- Unless otherwise required under Australian law, all purchases are non-refundable.
- Prices are displayed in Australian Dollars (AUD) unless otherwise stated and may vary depending on location or telecom provider.
- eSimDeck is not responsible for failed transactions due to insufficient funds, incorrect details, or third-party technical issues.
Nothing in these Terms excludes, restricts, or modifies your rights under the Australian Consumer Law (ACL).
5. Intellectual Property
- All content, features, design elements, and branding within the eSimDeck platform are the intellectual property of eSimDeck and are protected under applicable copyright and trademark laws.
- You may not copy, reproduce, modify, distribute, or reverse-engineer any part of the platform without prior written consent.
6. Third-Party Services
- eSimDeck integrates with third-party telecom operators and payment service providers.
- We are not responsible for service interruptions, errors, or policies of these third parties.
- By using eSimDeck, you also agree to comply with the terms and policies of relevant third-party providers.
7. Limitation of Liability
To the maximum extent permitted by law, eSimDeck is not liable for:
- Service disruptions caused by telecom operators
- Device compatibility issues
- Loss or damage resulting from network failures
- Unauthorized use of your account or eSIM
Services are provided on an “as is” and “as available” basis.
Where required by law (including under the Australian Consumer Law), certain guarantees may apply and cannot be excluded. In such cases, eSimDeck’s liability is limited (at its option) to:
- Re-supplying the services; or
- Paying the cost of having the services supplied again.
8. Termination
- eSimDeck may suspend or terminate your access if you breach these Terms or applicable laws.
- You may stop using the service at any time by uninstalling the App or ceasing use of the website.
9. Privacy
- eSimDeck collects and processes personal data in accordance with the Privacy Act 1988 and the Australian Privacy Principles (APPs).
- Please review our Privacy Policy to understand how your data is collected, used, and protected.
10. Changes to Terms
- eSimDeck may update these Terms from time to time.
- Updates will be communicated via the App or website. Continued use of the service constitutes acceptance of the updated Terms.
11. Governing Law
- These Terms are governed by the laws of New South Wales, Australia.
- Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
